Legacy Golf Course Update II

Legacy Golf Course was sold in early July and subsequently closed for business. As a result, the community of The Grand Legacy Community Association ("Grand Legacy") filed a lawsuit on July 21, 2017, asking the court to grant a Temporary Restraining Order ("TRO") to force the new owners to maintain the property as a golf course. Grand Legacy successfully obtained the TRO on August 8, 2017. Thereafter, a sub-association of Green Valley Village, The Master Series at the Legacy Community Association ("Master Series"), joined in the litigation as a plaintiff.
On August 29, 2017, Grand Legacy and Master Series successfully moved the court to appoint a receiver to oversee and inspect the course weekly. This receiver reports back to the court to ensure compliance with the TRO. Although not required to do so by the TRO, the owners recently reopened the golf course for business.
In order to protect the association's interests in the applicable deed restriction and its own restrictive covenants, Green Valley Village joined the litigation by filing a motion on September 19, 2017. Both Grand Legacy and Master Series supported this request and the defendant owners did not oppose Green Valley Village becoming a party. Therefore, Green Valley Village's request was granted on October 3, 2017.
Because the new owners' long-term intentions toward the golf course remain unclear, and the TRO is only temporary, the plaintiff communities, including Green Valley Village, are moving forward with the case. Recently, the board members of the association parties attended a mandatory settlement conference on November 20, 2017. The board is permitted to report that no settlement was reached during the settlement conference. However, the parties have agreed to keep the lines of communication open and continue to work toward potentially finding a mutually agreeable resolution. The trial is currently scheduled for March 12, 2018.
